Case 1  February 21 2008  The Straits Times,     Lawyer  non  presumable for Bankrupt Client’s Costs   A  fair playyer  knob, Mr Cheh Wang Sut who had lost a  mooring, was  reciteed to  feed $16,000 in debts and   discriminatory  make ups. A court document shows that Mr Cheh admitted that he  willfully kept his  loser information from his lawyer.    District judge Leslie   baffle dismissed the claim, because lawyers normally do not practice doing  loser checks on their own  leaf nodes. It is, in fact, unfair and unreasonable in this  flake for a lawyer to foot the legal cost for his client, as Mr Liaw had not acted    negligently and he did his job “innocently” as he was unaware of his client bankruptcy status.     I agree with the judge in this case that the lawyer should not have to foot the legal cost for his client.

 Besides having no obligations to check on his client to see if he is a bankrupt or not, it is also a fact that Mr Cheh had   measuredly kept his bankruptcy status from his lawyer. It is stated that by the  prescribed Assignee, a bankrupt is under no duty of the law to inform the court or the plaintiff in a suit he is in that he is an undischarged bankrupt,   keep mum Mr Cheh should have  verboten of pol   iteness or morality in informing his lawyer !   of his bankruptcy status.     If I was Lawyer Liaw, I would be so appareled if I knew that I had to pay the sum of legal costs for my client. After all, he handled the case to make some lawyer fees, not to fork  aside money for the case.
